Smart medical devices, utilizing new technologies such as artificial intelligence, the Internet of Things, and data mining, have brought about a significant transformation in the fields of diagnosis, treatment, and medical care. These devices have improved the quality of life of patients by increasing the accuracy and speed of medical services; however, the use of these complex technologies has also brought about new legal challenges Background and aims: One of the most important of these challenges is determining the limits and dimensions of civil liability arising from improper performance or defects in smart medical devices. Method: The research method used in this study is descriptive-analytical and comparative. The data are collected through the study of library documents and resources, content analysis of laws and regulations, and comparative study of laws in Iran and other countries, and are examined using logical and argumentative analysis, legal analysis, and comparative analysis. Results This article aims to examine the legal dimensions of civil liability arising from the use of smart medical devices, analyzing the theoretical foundations of civil liability, relevant laws and regulations in Iran and other countries, and challenges related to proving fault and causation. In addition, issues related to privacy, medical data security, and the role of various factors including manufacturers, healthcare providers, and AI developers in determining civil liability are examined Conclusion: Based on the research findings, solutions are presented such as formulating specific laws in the field of smart medical devices, establishing quality monitoring and assessment systems, developing technical and ethical standards, and increasing awareness and training of users and specialists.
